Terms and conditions for Visitor Ready

 

In these Terms and Conditions, "AA Media" means AA Media Limited of Grove House, Lutyens Close, Chineham Court, Basingstoke, RG24 8AG. The "Property" or “Business” or "Applicant" means the accommodation, visitor attraction or other hospitality or tourism business which is to be verified as set out in the application process. The "Scheme" or “Visitor Ready” means the Visitor Ready accreditation scheme to which Applicants may apply in accordance with these Terms and Conditions. 

The "Term" means the term of the Agreement starting on the date that an Applicant is informed its application for Registration has been successful and ending at the time of the cessation of the Applicant's certification under the Scheme. 

This "Agreement" will include these Terms and Conditions, the Visitor Ready Charter and  Privacy Notice. 

 

1. The Applicant acknowledges that the Scheme has no statutory footing and has not been approved by the UK Government or any relevant UK health authority or public body (each a "Relevant Authority"). The Scheme is operated and maintained by AA Media at its discretion and AA Media reserves the right at any time to terminate or suspend the Scheme including following any intervention by a Relevant Authority and in such circumstances the Applicant will promptly comply with any instructions issued by AA Media. 

 

2. Admittance into the Scheme constitutes a confirmation by AA Media that the Applicant has fulfilled the application steps required as set out in the below ("-") (“Application), such steps being subject to change by AA Media at any time:    a. Valid evidence of requested procedures and measures in place at Property;    b. online confirmation of adherence to requirements in respect of specific named polices at the Property. 

 

3. The Applicant warrants and represents that all information provided to AA Media as part of the  Application process is true and accurate and has been prepared with a reasonable level of care and skill. The Applicant acknowledges that it has been solely responsible for the preparation of the material required for the Application and the provision of that material to AA Media for assessment. 

 

4. The Applicant agrees that the details provided for  verification will be checked online by AA Media and undertakes to give further clarification if required.  Application may,also entail a physical visit to the premises by AA Media or its authorised representatives if deemed necessary or at AA Media’s discretion. 

 

5. The Applicant acknowledges that admittance to the Scheme does not constitute any assurance from AA Media regarding the safety of the Property or as to the level of risk to guests visiting the Property. The Applicant acknowledges that accreditation under the Scheme is not a substitute for the Applicant's own care and diligence and adhering to the applicable health requirements, advice or guidelines of Relevant Authorities. 

 

6. Accreditation under the Scheme is continuous, unless subject to withdrawal or suspension, from and including the date on which the Applicant receives written confirmation from AA Media of admission to the Scheme. If the Scheme is closed, AA Media will confirm the steps the Applicant needs to take to remove certification and logos. 

 

7. Upon admittance to the Scheme and confirmation of the Applicant's right to display the "Visitor Ready Accreditation Mark", the Applicant will become eligible to display the Visitor Ready Accreditation Mark in any printed or electronic media and at the Property itself. By displaying the Visitor Ready Accreditation Mark the Applicant confirms its adherence to the Terms and Conditions of the Scheme as they may apply from time to time. 

 

8. AA Media may amend the Agreement at any time, including following changes to public health regulations or the issuance of new or updated guidance by any Relevant Authority. AA Media will use reasonable endeavours to inform Scheme participants as soon as reasonably practicable of any amendments to the Agreement. 

 

9. The Applicant will provide to AA Media without delay the latest version of any information or material provided at Application that is subsequently updated or otherwise amended via the Visitor Ready website or by email . The Applicant is required to maintain consistently the safety standards stipulated in the Agreement and to display the Visitor Ready Mark. The Applicant will notify AA Media without delay of any material change that may result in the Applicant falling below such standards.  

 

10. Any materials or guidance provided by AA Media to the Applicant in connection with the Agreement will remain the property of AA Media. 

 

11. The Applicant will keep confidential all information of AA Media and will only use the confidential information as required to advertise the Visitor Ready Accreditation Mark. 

 

12. In the event of complaints about a Property of which AA Media becomes aware, the Applicant will allow access to authorised representatives of AA Media for the purposes of investigating the complaint. AA Media may also, following the provision to the Applicant of reasonable notice in writing, conduct ad hoc visits to premises in order to determine compliance with the Agreement, irrespective of whether any complaint regarding the Applicant has been received. 

 

13. AA Media may withdraw or suspend Applicant certification at any time including but not limited to where the Applicant is no longer considered by AA Media to meet the standards required under the Agreement or where in AA Media's opinion the Property is no longer capable of operating safely. In the event that AA Media withdraws or suspends a Visitor Ready Accreditation Mark for whatever reason, the Applicant will ensure that this is promptly and accurately reflected on any physical, printed or electronic media. 

 

14. The Applicant will comply with all laws, enactments, regulations, regulatory policies, guidelines and industry codes applicable to it and will maintain such authorisations and all other approvals, permits and authorities as are required from time to time to perform its obligations under or in connection with the Agreement.  

 

15. In no circumstances will AA Media be liable in contract, tort (including negligence), misrepresentation or breach of statutory duty, i) for any increased costs or expenses or ii) for any loss of profit, business, contracts, revenues or anticipated savings, as a result of the Property displaying or not displaying the Visitor Ready Accreditation Mark. 

 

16. The Applicant acknowledges that, following Registration, AA Media will bear no liability in respect of customers of the Applicant and will under no circumstances be liable to the Applicant, any customer of the Applicant or any third party in respect of any complaints, claims or disputes arising out of or in connection with the Applicant's certification under the Scheme, including any reputational damage suffered by the Applicant as a result of failure to adhere to specific legislation at the premises, and the Applicant indemnifies and will keep indemnified AA Media from and against any such liability. 

 

17. AA Media may terminate the Agreement at any time by giving not less than thirty (30) days' notice in writing to the Applicant. For the avoidance of any doubt, the Agreement will automatically terminate at the end of the Term. 

 

18. On termination of the Agreement, howsoever caused, the Applicant shall immediately, and no later than within five (5) days, at the Applicant’s own expense, remove the Visitor Ready Accreditation Mark and references to the Visitor Ready Accreditation Mark from all its materials. If, after five (5) days following termination of the Agreement, the Applicant has not complied with its obligations to removal of all signage containing the Visitor Ready Accreditation Mark, the Applicant will allow AA Media or its Authorised Representatives such access as they require to the Property to remove all Visitor Ready Accreditation Marks displayed at the Property. The Applicant will pay to AA Media all costs and expenses thereby incurred. 

 

19. If a Property is sold as a going concern during the Term, the right to display the Visitor Ready Accreditation Mark shall end automatically and the new owner shall have to make a new application in their name. 

 

20. The parties are independent persons and are not partners, principal and agent or employer and employee and the Agreement does not establish any joint venture, trust, fiduciary or other relationship between them, other than the contractual relationship expressly provided for in the Agreement. None of the parties shall have, nor shall represent that they have, any authority to make any commitments on the other party’s behalf. 

 

21. The Agreement and any dispute or claim arising out of, or in connection with, it, its subject matter or formation (including non-contractual disputes or claims) will be governed by, and construed in accordance with, the laws of England and Wales. The parties irrevocably agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of, or in connection with the Agreement. 

 

22. The Applicant may not assign, subcontract or encumber any right or obligation under the Agreement, in whole or in part, without AA Media's prior written consent. 

 

23. If any provision of the Agreement (or part of any provision) is or becomes illegal, invalid or unenforceable, the legality, validity and enforceability of any other provision of the Agreement shall not be affected and shall continue in full force and effect.

 

24. No failure, delay or omission by AA Media in exercising any right, power or remedy provided by law or under the Agreement shall operate as a waiver of that right, power or remedy, nor shall it preclude or restrict any future exercise of that or any other right, power or remedy.
